We have appointed a Data Protection Officer (DPO) to supervise compliance with this legal notice. You have the right to lodge a complaint with a supervisory authority at any time. For us, as a data controller, the main data protection supervisory authority is Radeal Sp. z o.o with headquarters in Michałowice, ul. Fiołkowa 1, 32-091, Krakow, Poland. What is the purpose of processing your personal data? We use the information provided by customers and users for the following purposes: To manage the sending of the information that they request, to provide them with offers of goods or services of their interest, and to be able to offer our goods and services in accordance with their interests and improve their user experience. To fulfill these purposes, we will prepare a commercial profile based on the information provided. No automated decisions will be made based on database profiles. Automated emails will be sent, previously programmed by the data owner, service providers, or employees. General Conditions

Through these general conditions, we make the pre-contractual information available for users and customers.

First, identification: The services that are sold through this website are design services and digital content. On this website, you are actually contracting with ALPE Services Pedro Escudero González, which is based in the city of Cracow, Os. Bohaterów Wrzesnia 84, 31-621, with NIP: 6751575023 and REGON: 366388242, with email info@bimconverter.com and owns the registered brand of BIM Converter.

Second, goods and prices: Digital products can be purchased on the website. The prices of the goods or services are shown on our website and are indicated in Euros, Dollars or Pounds which does not include taxes. In case of purchasing any goods or services and being subject to tax exemption, we only accept wire bank transfer payments from companies with a valid tax number.

Third, to book an appointment: To book an appointment we use a third-party saas which is called “Calendly”. We insert the iframe in our website. Calendly is responsible for its own legal terms and privacy policies and we are exempt from any responsibility of any third-party tool. You can find more information on calendly.com. From our side, we collect personal data as “Name” and “Email”, and company data as “Company Name” and the “Taxpayer Identification Number”. The data we collect will be processed and incorporated into our files, as reported in our personal data protection section contained in this Legal Notice.

Payment method: For goods or services, it will be by wired bank transfer upon proforma invoice. The corresponding invoice will be issued upon receipt of the amount in our bank account. ALPE Services is an EU taxpayer and delivers invoices under a VAT reverse charging regulation.

In relation to the delivery dates, the delivery date is described within the invoice or any other contract document.

There is no geographical limitation on access to the content sold on our website. The products sold on our website enjoy all intellectual property protection rights and other legal guarantees. All necessary technical measures will also be used to guarantee the security of the purchase and access to digital products safely.

Fourth, cancellation and returns: The client of our website undertakes at all times to provide truthful information about the data requested in the different forms. In the event that the sale or marketing of products on our website requires the buyer to be of a certain age according to the legislation in force in their country of origin, the buyer states that they meet this requirement to formalize the purchase.

The right of withdrawal will apply accordingly to the invoice or any other contract information. But as a general rule, we don’t make any refund on our services once the execution has started.

Contracting Services with Us

All modeling services we provide are regulated by the PIR (Project Information Requirements) and the EIR (Exchange Information Requirements). Among all, it details the key points of the project like the author of models, licenses, coordination, descriptions, deadlines, and guarantees. In addition, the IE (Information Exchange) is being developed during the work and it collects the decisions and status of the work. Finally, the PIM (Project Model Information) is delivered, which consists of the final model(s).

We can offer the CDE (Common Data Environment) service that will consist of a file-sharing cloud between clients and us, exclusively for uses related to the service. The exchange cloud will be managed by a third party and will be subject to its terms, conditions, and privacy policy. We are not responsible for the legal, usage, and privacy terms of this. 

Inside PIR and EIR we will give information about:

  1. Project’s name. Name of the project.
  2. Software and license: The software to be used and the license to use will be described.
  3. Duration of the project: Start date, target end date, and actual end date.
  4. Service description. The service to be performed will be described.
  5. A detailed list of models to perform.
  6. Method of delivery and payment, according to item.

We assign a BIM coordinator to all services. The BIM Coordinator will be the point of contact and the one in charge of transmitting the Customer’s information to our modeling team. The BIM Coordinator data below will appear in the PIR and EIR: 

  1. Name and surname of the BIM coordinator.
  2. Primary email.
  3. Phone number.

During the work-in-progress phase. We document the Information Exchange (IE) with information as:

  1. Data register. Describes the activities that are being carried out by us.
  2. A detailed listing with the model elements, with the objects or products to be made. Describe the date of the first delivery, review, and final delivery.
  3. Parameters or LOD of the project, in case. A detailed description of the parameters or the Development Level (LOD) of the design elements.
  4. Corrections. Registration of corrections and details that will be made during the development of the works and its warranty period.

The BIM Coordinator will automatically add those parameters or elements that are necessary to guarantee the functionality and quality of the design. Even if a previous consultation with the client could not be made but such modifications or extensions will not affect the general conditions agreed upon. Furthermore, will not modify the geometry of the design, in such case, will only be modified after consultation and acceptance by the Client.

It will be two methods of delivery:

  • Offered by us. The file-sharing CDE cloud service is provided by a third party.
  • External exchange service offered by the client. External exchange service offered by the client. The customer may offer an alternative service of information exchange. The client will have full responsibility and knowledge of the use and where we disclaim any liability in case of loss, removal, or theft of information by a third party or the same customer.

This service is voluntary; the client is the one who accepts the conditions proposed by us and agrees to pay the agreed amounts in the corresponding periods.

Due to the nature of the work and the expenses derived from personnel and licenses, the prepayment will be required for each period of working time that will entail the development of the models according to this document and the documents agreed between both sides. It means, that at the beginning of the work, the client will be requested to pay in advance for the corresponding working period. Until we don’t receive the amount corresponding to the term of work, we won’t begin any activity.

We are exempt from liability for non-compliance with deadlines in case of loss of the customer’s password from the CDE or not being able to access the products due to the interruption of services, due to maintenance, or factors external to us. We are committed to finding an alternative way for the delivery of the models as soon as possible once we received the notification from the client.

Budget estimation is made for the execution of a closed-price contract. Furthermore, that estimate is based on performance and work units. If the customer request additional changes based on unplanned tasks that exceed the initial scope of the jobs, the overtime will be billed within a change order. In other words, if the customer wants to implement certain changes, not included in the PIR and EIR, during work in progress, the final price may vary.

If in case of force majeure work cannot be carried out in any way, we undertake to return the amount corresponding to the work not performed to the customer by bank transfer within 15 days; without any additional liability arising from term damages or requirements of the customer.

This intellectual property shall cover all areas applicable in accordance with existing intellectual property legislation. Both companies shall recognize their own industrial and intellectual property rights. Performing a service does not imply any transfer or authorization in addition to what was agreed in the previous point.

The Non-disclosure of the information provided by us and the client for the development of the work, in any case, must be respected. If one of the parties wishes to make use of the second party’s information, it will need written permission on any available digital media. It will be treated as confidential information, all information that the Customer provides to us and the opposite, as well as emails and messages by other digital measures unless an express authorization was received. It will no longer be considered confidential information when it becomes available to the public and obtained by the receiving party from another source without obligation and confidentiality. We always use original and own content and never use models from other third parties. (Excluding generic objects from installed software).

Terminations, Changes, and Jurisdiction

TERMINATION CLAUSE: We may terminate your access to the site, without cause or notice, which may result in the seizure and destruction of all information associated with your account. All provisions of this Agreement that by their nature should survive termination will survive termination, including without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
